Subject: AB 1825 2009 Training Cycle Announcement

This message is notification of the upcoming biennial requirement of mandated training and education in the prohibition against and the prevention of sexual harassment in employment. Under California Law AB 1825 (Gov. Code, Sec. 12950.1), employers having 50 or more employees are required to provide at least two hours of classroom or other effective interactive training and education regarding sexual harassment to all supervisory employees once every two years. This will be the University of California's third iteration of the program since passage of the law.

A "supervisor," as defined by the President of the University, includes all employees who supervise in administrative and academic units. The definition also includes all faculty and lecturers. ALL faculty are required by law to undergo this training, because of the authority such positions hold over students since they supervise students in honors thesis, MA thesis, or doctoral thesis preparation and/or supervise GSIs, GSR's, and/or Readers.

Therefore, it is the responsibility of all members of management to ensure that required training of their supervisors and mangers is completed.

Three options will be available to satisfy this two-hour requirement:

  1. UCOP On-Line Program: Faculty and other supervisors may take the two-hour online education program that will be administered through the Office of the President. The Office of the President Learning Center will send to each identified supervisor a personalized link to the online education course. Periodic reminders will be sent from UCOP Learning Center during the 90-day mandatory completion cycle.   2. Instructor Led Workshops: Faculty and other supervisors may also satisfy the requirement by attending an instructor-led workshop. These two-hour workshops are interactive and use case scenarios to illustrate the complexity of issues and formulate effective problem-solving strategies. Campus Climate and Compliance (CCAC) currently has workshops scheduled monthly through the campus UCB Learning Center interactive course enrollment. Employees can register for AB 1825 Sexual Harassment Prevention for Supervisors/Faculty at http://hrweb.berkeley.edu/ice/home/. Presentations are held in 150 University Hall and other campus locales. Announcements will go out to departments specifying dates/times for spring semester 2009.
    Chairs and managers may invite Maria Padilla, Compliance Education Manager to their units to facilitate a tailored two-hour workshop for faculty, graduate students and other supervisors. These can also be divided into two one-hour sessions. Those who are interested in this option may contact Maria Padilla at 643-9707, or via email at mlucerop@berkeley.edu.
  3. Interactive Theater Program: Faculty and other supervisors may also satisfy the requirement by attending an AB 1825 Interactive Theater Program performance. The Berkeley Interactive Theater Program (ITP) is a collaboration of the Vice Chancellor for Equity and Inclusion and the Campus Climate and Compliance Office. These workshops use live theatre and audience participation to depict, analyze, and strategize solutions to problematic workplace situations. Performers will present workplace scenarios on a range of Sexual Harassment related issues. These are two-hour programs. Announcements will go out to departments specifying dates/times for spring and fall semesters 2009.
    If you receive a report or an inquiry regarding possible sexual harassment or assault from a student, staff or faculty member, please contact Assistant Vice Provost and Title IX Compliance Officer Nancy Chu, at 643-7985, before responding to any situation. She is available to guide and advise you about appropriate strategies for promptly addressing complaints or concerns.
